1. Introduction

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Trader365 Ltd (“Trader365®”, “we”, “us”, or “our”), a company incorporated under the laws of the United Kingdom, regarding your access to and use of the Trader365® mobile application, website, and any related products, services, or content provided by us (collectively, the “Services”).

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Risk Disclaimer, Community Guidelines, and any other policies referenced herein. If you do not agree to these Terms, you must not use the Services.

2. Eligibility

2.1 You must be at least eighteen (18) years of age to create an account or use the Services.
2.2 By using the Services, you represent and warrant that you meet the minimum age requirement and have full legal capacity to enter into and comply with these Terms.
2.3 We reserve the right to request proof of age and to suspend or terminate accounts where age verification fails, in accordance with our Underage Policy.

3. Description of Services

3.1 Trader365® provides tools, educational resources, and AI-assisted guidance for trading psychology, discipline, and mindset development.
3.2 The Services are provided for educational and wellbeing purposes only and do not constitute financial, investment, tax, legal, or other professional advice.
3.3 We do not provide trading signals, execute trades, or offer specific investment recommendations.
3.4 Access to certain features may require payment of applicable fees in accordance with Section 7.

4. Account Registration and Security

4.1 To access certain features, you must register for an account using accurate and complete information, including your name, email address, and other required details.
4.2 You may register using third-party authentication providers such as Google Sign-In or Apple Sign-In.
4.3 You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
4.4 You must notify us immediately at support@trader365.co.uk if you suspect any unauthorised use of your account.
4.5 We shall not be liable for any loss or damage arising from your failure to secure your account.

5. Acceptable Use and Prohibited Conduct

5.1 You agree to use the Services only for lawful purposes and in accordance with these Terms.
5.2 You must not:

• Engage in fraudulent, misleading, or unlawful activities.

   

• Share or solicit financial advice, trading signals, or investment recommendations.

   

• Upload or distribute any harmful code, malware, or unauthorised data scraping tools.

   

• Harass, threaten, or abuse other users or our staff.

   

• Infringe the intellectual property rights of Trader365® or third parties.

   

6. Intellectual Property

6.1 All content, software, designs, graphics, logos, and trademarks displayed within the Services are the exclusive property of Trader365® or its licensors, and are protected by copyright, trademark, and other intellectual property laws.
6.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes only.
6.3 No content or materials from the Services may be reproduced, distributed, modified, or otherwise exploited without our prior written consent.

7. Payments, Subscriptions, and Refunds

7.1 Certain features are available on a paid subscription basis via Stripe (Android) or Apple Pay (iOS).
7.2 You agree to pay all applicable fees in accordance with the pricing displayed at the time of purchase.
7.3 Subscription renewals will be charged automatically unless cancelled before the renewal date.
7.4 Refunds will be processed only in accordance with applicable consumer laws and our internal refund policy.

8. Disclaimers and Limitation of Liability

8.1 The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied.
8.2 We expressly disclaim any warranties regarding accuracy, completeness, or reliability of any content or third-party data.
8.3 To the maximum extent permitted by law, Trader365® shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

9. Risk Acknowledgement

9.1 By using the Services, you acknowledge and accept the risks outlined in our Risk Disclaimer, including the possibility of losing some or all of your investment capital.
9.2 You agree that you are solely responsible for your trading and investment decisions.

10. Suspension and Termination

10.1 We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have breached these Terms or engaged in prohibited conduct.
10.2 Upon termination, all rights granted to you under these Terms shall cease immediately.

11. Governing Law and Dispute Resolution

11.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
11.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11.3 You agree to attempt resolution of disputes through good-faith negotiation before pursuing legal remedies.

12. Amendments to the Terms

We may amend these Terms from time to time. Changes will be posted on our website and app. Continued use of the Services after changes take effect constitutes your acceptance of the amended Terms.
